Evernote Privacy Notice for Job Applicants

Evernote is committed to protecting the privacy of your data. This Privacy Policy for Job Applicants includes information about the personal information Evernote Corporation and its Group Companies (together, “Evernote,” “we,” “us,” or “our”) process about job applicants or other individuals who apply to work for Evernote and third parties whose information is provided to us in connection with the application, such as references.  

This Privacy Policy does not cover information collected about you as an Evernote customer or visitor to Evernote-affiliated websites. To learn more about our information collection practices in those situations, please read our online Privacy Policy at https://evernote.com/privacy/policy.

If you accept an offer from us, we will process further information from you in your capacity as an employee or contractor, described in the Evernote Privacy Notice for People Data (provided as part of the on-boarding process).

The Categories of Personal Information We May Collect 

We may collect information you provide directly to us, information about you that we develop during our interaction with you, and information that we obtain from other sources. The types of personal information we may collect include: 

• Identifiers, such as a name, alias, mailing address, email address, phone number, IP address, unique personal identifier, social security number, driver’s license number, passport number, or other similar identifiers.
• Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) such as your name or the commercial, professional, or education information described below. 
• Characteristics of protected classifications under applicable law. 
• Biometric information.
• Internet or other electronic network activity information, as may be required during the hiring process, such as the results of an online skill test.
• Geolocation data.
• Audio, electronic, visual, thermal, olfactory, or similar information, such as cameras or CCTV we install in our premises for security or safety, if you come to one of our locations for an interview.
• Professional or employment-related information, such as your resume, cover letter, references, employment application, skill sets, accolades received, information provided by references, background checks, our assessment of recruitment information.
• Education information, such as information about your education you disclose in your application.
• Sensitive personal information, such as:
  • Social security, driver’s license, state identification card, or passport number.
  • Account log-in in combination with any required security or access code, password, or credentials allowing access to an account.
  • Precise geolocation.
  • Racial or ethnic origin, religious or philosophical beliefs, or union membership.
  • Personal information collected and analyzed concerning health.
  • Personal information collected and analyzed concerning sex life or sexual orientation.

For each of the categories of personal information above, we retain such information for as long as necessary to comply with our legal obligations, for the exercise or defense of legal rights, and for archiving, back-up, and deletion processes. We also keep information for a reasonable period of time to keep you informed of future employment opportunities. 

The Purposes for Which We May Use Personal Information

We may use personal information about you related to the assessment of your application, in compliance with our legal obligations, in the legitimate interests of Evernote, and where we have your consent. These purposes include: 

• Administering the application process and assessing your skills, qualifications, and suitability for the position, including information verification.
• Carrying out compliance functions.
• Conducting consultations or negotiations directly with you or through representatives.
• Maintaining your application record for current and future hiring processes, including to communicate with you and provide you with information regarding potential career opportunities that suit your profile.
• Complying with regulatory rules to which we may be subject.
• Monitoring and actioning programs to ensure equality of opportunity.
• As otherwise related to your application to work for Evernote.

How We May Disclose Personal Information

Here are instances when we may disclose your personal information — and then only the minimum information necessary: 

• We may disclose your information with our parent, subsidiaries, and affiliated companies.
• We may disclose your information with service providers who process data on our behalf, such as background-checking or other screening providers. We require these providers to agree to strict data protection requirements in keeping with our privacy policy standards and our obligations under data protection laws.
• We may disclose information where we believe disclosure is necessary or required by law or regulation to comply with legal process or government requests, or to exercise, establish, or defend our legal rights.
• In the event of a merger, sale, or reorganization of all or part of our business, we may disclose your information in connection with that deal.
• We may disclose your information whenever you consent to or direct such disclosure.

These disclosures do not reflect our collection, use, or personal information handling practices with respect to residents’ personal information where an exception or exemption applies under applicable law, including the California Consumer Privacy Act for 2018, as amended from time to time, including the California Privacy Rights Act and its implementation regulations (“CCPA”). We do not sell or share (as defined under the CCPA) any of the categories of personal information we collect about you.

Your Privacy Rights

Depending on where you are located, you may have certain rights in relation to your personal information, and we will not discriminate against you if you choose to exercise those rights. These rights can differ by country and may include the right to: 

• Access personal information we have collected about you.
• Delete your personal information (subject to certain exceptions).
• Correct your inaccurate personal information.

You may also have the right to port your data, withdraw your consent, object to the processing of your personal information, or restrict processing of your personal information.

To exercise any of your rights, please contact us at hr@evernote.com. In the subject line of your email, please write “Privacy Rights Request”. Note that in order to fulfill your request, we may need you to provide certain information to verify your identity, such as providing evidence that matches the personal information we maintain about you. You can designate an authorized agent to exercise these rights on your behalf. Your authorized agent will be asked to verify (i) the individual about which the request relates, and (ii) their identity and written authorization to act as your agent. We may ask you to directly confirm to us that you have given permission to the authorized agent to submit the request.
